The Court of Justice of the European Union has ruled that publishers are legally unable to stop people reselling digital games.

“An author of software cannot oppose the resale of his ‘used’ licences allowing the use of his programs downloaded from the internet.”
The exclusive right covering the distribution of a copy of a game is “exhausted on its first sale,” said the ruling.
This means you are legally able to resell downloaded computer games, whether no matter where you bought it and no matter what EULA is associated with the retailer.
The ruling continues: “Therefore, even if the licence agreement prohibits a further transfer, the rightholder can no longer oppose the resale of that copy.”

I would say if it is done right it could really help the pre-owned market but it looks like there will have to be some kind of system created around it to make it work properly. At least it will make greedy publishers like EA think twice about all the overpriced digital content it is ripping people off with.

here here RE your last comment, the current industry is a complete sequel whore and its being sucked dry by people like EA who won't let people part ex games... has anyone else noticed all the GAME stores now gone? with only CEX left to play the field? LONG LIVE CEX!!!

All of the Game stores have not gone and EA are not completely to blame for all this. It is a mixture of greed from both sides that caused it to happen.
Games were selling pre owned games at £2 under retail and getting 100% of the profit.
Shocking.
